The Court of Appeal Wealden District Council 2015

The recent Court of Appeal decision successfully allowed the challenge to Policy WCS12 of the Wealden District Core Strategy Local Plan which required all development within 7km of the Ashdown Forest to provide suitable alternative natural green space (SANG’s) to mitigate impact of increased visitors to this protected forest.

The result of this decision has meant that developments beyond the 7 km zone also need to be assessed against the Habitat Regulations and ‘appropriate assessment.’ However, there has been a change in the way Wealden District Council is determining applications and the use of Grampian conditions is being considered.
